Cycle Tours is committed to fair trading and all tours conducted are sold
and operated according to the following conditions: 1) YOUR BOOKING - All payments must be made in Australian Dollars. All bookings are made and accepted subject to the terms set out in these conditions. We reserve the right to refuse a booking without explanation but will refund your deposit if we do refuse your booking. To make a booking you must send us a completed booking application and a non-refundable deposit for each person. We will receipt this deposit and then invoice you for the remainder of the tour price, which you must pay no later than two calendar months before departure. A receipt for the balance will then be issued together with a confirmation of your acceptance on the tour. If you are successful in booking less than two calendar months prior to departure, full payment must be made on booking. If the balance is not paid on time we reserve the right to cancel your holiday and apply the cancellation charges outlined below. If the booking is not accepted, no contract exists between yourself and Alpine Cycle Tours. If the booking is accepted, a contract will exist between yourself and Alpine Cycle Tours from the date shown on the confirmation issued. 2) CANCELLATION BY YOU - If you wish to cancel your holiday, this must be done in writing by the person whose name the holiday is invoiced to. You will be liable for the following cancellation charges: a) 56 days or more before the departure date you will only forfeit your deposit b) Between 56 and 28 days before the departure date you will forfeit your deposit and 50% of the tour price. c) Less than 28 days before the departure date and you will forfeit the deposit and the full tour price. The cancellation occurs the first business day after we receive your written notification. Please note that if the reason for the cancellation falls within the terms of any insurance policy, which you may hold, then the insurance company may refund any such charges to you. *If we have effected insurance on your behalf, the insurance premium is forfeited on cancellation. 3) INSURANCE - To take part in a tour you must take out adequate insurance cover at the time of booking. This will help to protect you in the event that any cancellation charges are incurred as well as repatriation costs if you become too ill to continue. Any claims concerning matters for which you are insured must be directed to your insurers. While we do require you to take out your own insurance cover Alpine Cycle Tours is covered by its own Public Liability Insurance and Professional Indemnity Insurance and the appropriate premiums for these insurances are included in the tour price. 4) CANCELLATION BY US - We may cancel your tour if: a) we are forced to do so by unusual or unforseeable circumstances such as war, civil or political unrest or what is usually known as "force majeure". b) the minimum number of people needed to operate our holidays has not been met. In this case we will seek to advise you not less than 28 days prior to the departure date. Should we, for any reason, be forced to cancel your tour a full refund will be paid within 10 working days of notifying you of the cancellation We reserve the right, in any circumstances, to cancel your tour. We will try to avoid cancellations occurring within 28 days prior to the departure date other than for the reasons detailed in this section above or in section 5 below. CHANGES BY US - We plan our tour arrangements many months in advance and though it is unlikely we will have to make any changes to confirmed arrangements, it does occasionally happen. Most changes are of a minor nature and we will advise you at the earliest possible date. If we are forced to cancel or in any way change your tour due to war or threat of war, riots, civil commotion, industrial disputes, disaster, terrorist activities, climatic conditions, technical or other problems with transportation, alteration or cancellation of scheduled services or other events outside our control, we will not be liable for any modification, cancellation or extension or delay in the arrangements or any loss suffered as a result. |

5) OUR POLICY ON SURCHARGES - The price of a tour is subject to surcharges on the following items: a) Governmental action b) Currency We will absorb an amount equivalent to 2% of the tour price, which excludes insurance premiums and any amendment charges. Only amounts in excess of the 2% will be surcharged together with an amount to cover the agent’s commission. If this means paying more than 10% on the tour price, you will be entitled to cancel your tour with a full refund on all money paid except for any premium paid to us for holiday insurance or amendment charges. Should you decide to cancel because of this, you must exercise your right to do so within 14 days from the issue date printed on the invoice. No surcharges will be applied within 30 days of your departure. We will not make any refund as a result of currency movement or reduction in costs. 6) RESPONSIBILITY - Cycling on or off the highway is a potentially dangerous activity. All persons participating in the tour do so at their own risk and by taking part in such activities acknowledge and assume the risks inherent therein. We do not accept responsibility for acts and/or omissions of our employees, agents or suppliers while acting within the scope of or in the course of their employment, agency or contract of supply and in particular: a) We shall not be responsible nor do we accept liability for death, personal injury or illness caused to you and/or any named person on the booking form. b) Where the tour consists of carriage by air or sea our obligations are limited in the manner provided by international conventions in respect of air and sea carriers. c) You use Alpine Cycle Tours transportation at your own risk and we cannot be held responsible for the conditions of any route incorporated in a tour, you follow any such routes at your own risk. d) Each person who takes part in a tour shall indemnify us against any and all liabilities, claims and costs incurred by or made against us arising out of any act or omission of that person or of the party of which that person is a member. e) We reserve the right to prohibit any person from taking part in a tour who, in our view, is a danger to him or herself or to any of the participants on the tour. In the event that we prevent such a person taking part in any tour pursuant to this sub-clause no refund or compensation whatsoever shall be payable by us. f) On such tours it is necessary that you abide by the authority of the leader. Signing our booking form signifies this, and therefore during a tour if your behaviour is detrimental to the safety and welfare of the group as a whole, the tour leader may ask you to leave the tour with no right to a refund. g) Should any rider not make the departure time for the tour due to circumstances beyond the control of the tour operator, then the tour operator is not bound to assist that rider to join the tour. However, every effort will be made by the tour leader and the support vehicle driver to have that rider join the tour provided it does not jeopardise the well-being and enjoyment of other riders. In cases where an attempt is made by Alpine Cycle Tours to have the rider join the group after missing departure, it will be done so at the rider’s expense. All persons who participate in a tour: i) Are responsible for arranging and paying for appropriate personal insurance cover for the duration of the tour. ii) Must observe all rules of the road in the relevant country. We do not accept responsibility for any expenses or loss incurred as a result of failure to observe the rules of the road in any relevant country. iii) Must possess all necessary visas, licenses, certificates and current valid passports as required by the law of any relevant country. We do not accept responsibility for any expenses or losses incurred as a result of failure to produce such documents when called upon to do so. Subject to the foregoing conditions, warranties and representations expressed or implied by statute, common law or otherwise in relation to the arrangements of tours by us are hereby excluded. 7) FLEXIBILITY - There is a natural need to be flexible in tours of this kind. The day to day agenda and ultimate destination of the tour is taken as a general aim and not as a contractual obligation. It is a fundamental condition of joining our tours that you accept this flexibility, and acknowledge that delays and alterations and their subsequent results such as inconvenience, disappointment or discomfort are possible. 8) BROCHURE PRICES - Prices and offers of tours organised by Alpine Cycle Tours are valid at the time of publication and include GST. You will be advised of any changes at the time of booking. 9) YOUR CONTRACT WITH US - Your contract with Alpine Cycle Tours is made on the terms of these booking conditions which are governed by Australian law and you agree to submit to the jurisdiction of Australian courts and specifically NSW jurisdiction and courts. 10) INFORMATION GIVEN - Information given by Alpine Cycle Tours in regard to visas, vaccinations, climate, clothing, special equipment, topography etc is done so in good faith and without responsibility on our part. 11) BAGGAGE - As space is limited in the support vehicle, baggage is restricted to 1 bike contained within a soft and collapsible bike bag approved by the airlines for travel within the baggage section of aircraft, one small suitcase and a small rucksack of no more than 35 litres capacity. Should riders wish to bring baggage in excess of these guidelines then they need to make their own arrangements for its storage whilst on the tour. These guidelines are set a reasonable level given the weather conditions for the time of year that tours are conducted in. 12) WAIVER - The booking conditions may only be waived by a Director of Alpine Cycle Tours in writing. |
